Appellants brought this application so as to adduce fresh evidence on appeal as relates to the judgement of the District Officer's Court of Appeal, Orlu Division dated 9th August, 1916 which was a review of the judgement of Orlu Native Court case No. 397 of 20th June, 1916.
They argued that though they pleaded the judgement in the case but could not get a certified true copy of it at the trial and that all efforts made by their counsel proved abortive and that the judgement found as a fact that the land in dispute belong to Amadichi/Amadehi compound, the applicants' predecessor -in- title and that any dispute with regard to the disputed land be referred to Ibuasiyi/Igboasoyi of Amadichi/Amadehi or his representative.
They engaged a new counsel reflected that it was necessary to their case and therefore efforts were made to obtain same at the National Archives.
